Throughout these Terms, “Active Nutrition”, “we”, “us” and “our” refer to ACTIVE NUTRITION LTD.

These Terms of Service apply when you browse our website, create an account or purchase products from us. Our Privacy Policy, Return and Refund Policy and Shipping Policy also form part of these Terms.

By using our website or placing an order, you agree to these Terms. Nothing in these Terms affects your statutory consumer rights.

  1. AGE AND ACCOUNTS

You must be at least 18 years old to place an order through our website.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You are responsible for keeping your account details and password secure. Please contact us if you believe somebody has accessed your account without permission.

We take reasonable care to ensure that product descriptions, prices, photographs, ingredients, serving information and stock information are accurate.

Product packaging, colours or appearance may occasionally differ from website images. Manufacturers may also update ingredients, packaging or formulas without notice. Always read the label and allergen information supplied with the product before using it.

If the product received is materially different from its website description, contact us before opening or using it.

Nothing in this section limits your rights where a product is faulty, damaged, unsafe or not as described.

  1. ORDERS

Placing an order is an offer to purchase products from us. An automatic order acknowledgement does not mean that we have accepted your order.

A contract is formed when we confirm that your order has been accepted or dispatched.

We may refuse or cancel an order before acceptance where:

  • A product is unavailable

  • There is an obvious pricing or product-information error

  • Payment cannot be authorised

  • We reasonably suspect fraud or misuse

  • Delivery restrictions apply

  • The quantity ordered exceeds reasonable personal-use quantities

If payment has already been taken for an order that we cancel, we will provide a full refund.

Please check your order carefully before submitting it. If you need to make a change or cancellation, contact us as soon as possible. We cannot guarantee changes once an order has entered the dispatch process.

Products purchased through our website are intended for personal or household use and not for commercial resale without our written permission.

  1. PRICES AND PAYMENT

All prices are displayed in pounds sterling.

The total price, including any delivery charge, will be shown before you complete payment.

Prices, discounts and promotions may change at any time, but changes will not affect orders that we have already accepted.

If we discover an obvious pricing error before accepting an order, we will contact you and give you the option to purchase at the correct price or cancel the order for a full refund.

Payments may be processed securely by Shopify Payments or another authorised payment provider. We do not directly store complete payment-card details.

  1. DELIVERY

Available delivery methods, charges and estimated delivery times will be displayed during checkout or explained in our Shipping Policy.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error.

Delivery dates are estimates unless we have expressly agreed to deliver by a specific date. We will deliver without undue delay and, unless another timeframe has been agreed, within 30 days after accepting your order.

Products remain our responsibility until they come into the physical possession of you or a person identified by you to receive them.

If an event outside our reasonable control delays delivery, we will take reasonable steps to reduce the delay and keep you informed. Your statutory rights concerning delayed or failed delivery remain unaffected.

  1. RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations and refunds are handled according to our Return and Refund Policy:

Online customers normally have a legal right to cancel eligible orders within 14 days after delivery. Our separate Return and Refund Policy also provides details of our 30-day return policy, eligibility requirements, exclusions and return instructions.

Nothing in our Return and Refund Policy or these Terms limits your statutory consumer rights.

  1. DAMAGED, FAULTY OR INCORRECT PRODUCTS

Products must be of satisfactory quality, fit for their intended purpose and as described.

Please contact us as soon as possible if a product arrives damaged, is faulty, is not as described or if you receive the wrong item.

Email activenutrition049@hotmail.com with your order number and photographs where possible. We will provide the appropriate refund, replacement or other remedy in accordance with UK consumer law.

  1. AVAILABILITY AND PROMOTIONS

All orders are subject to product availability. Placing a product in your basket does not reserve it.

Promotions, discount codes and special offers may have separate conditions, including expiry dates, eligible products and usage limits.

Unless stated otherwise, discount codes cannot be exchanged for cash or combined with another promotion.

  1. INTELLECTUAL PROPERTY

The content on our website, including our Active Nutrition name, logos, graphics, photographs, text and website design, is owned by or licensed to ACTIVE NUTRITION LTD and is protected by applicable intellectual-property laws.

Product names, logos and trademarks belonging to third-party manufacturers remain the property of their respective owners.

Our online store is hosted and powered by Shopify, which provides the ecommerce platform used to offer products to you.

All sales made through this store are made directly between you and ACTIVE NUTRITION LTD. Shopify is not the seller of our products and is not responsible for fulfilling your order.

Shopify may process personal information as explained in our Privacy Policy and Shopify’s own privacy information.
